Chaise R. Bivin

Chaise Bivin joined Severson & Werson in 2008 as Special Counsel after serving as the Associate General Counsel – Litigation & Employment at Accredited Home Lenders, Inc., a former publically held mortgage lender. While at Accredited, Mr. Bivin managed litigation on a nationwide basis for over 200 cases ranging from single borrower matters to class actions. In addition, Mr. Bivin routinely advised senior management regarding legal issues impacting the strategic goals of the company and counseled business groups with respect to litigation strategy and methods for risk avoidance.

Mr. Bivin has substantial experience defending litigation against mortgage lenders involving allegations of fraud, TILA and RESPA violations, predatory lending, wrongful foreclosure, unfair/deceptive practices, FCRA violations, title claims, and servicing issues. Mr. Bivin also has handled several repurchase claims involving the sale and/or securitization of mortgage loans in the secondary market.
 
Mr. Bivin represents clients in a wide array of cases in state and federal courts, at both the trial and appellate levels, as well as in alternative dispute resolution proceedings. Mr. Bivin has extensive experience managing complex cases in their pre-trial phases, including developing legal theories and strategic plans, drafting and arguing motions, working with fact and expert witnesses, and engaging in discovery. He routinely litigates document-intensive cases, and is familiar with the issues and procedures associated with electronic discovery.

Prior to his tenure at Accredited, Mr. Bivin litigated at a national law firm where his practice focused on business, real estate, and intellectual property litigation with an emphasis on complex litigation. Mr. Bivin has handled a variety of matters, including class actions, real estate litigation, employment related claims, land use, administrative law matters, securities litigation, intellectual property disputes, regulatory inquiries, contract disputes, health care litigation, and internal company investigations.
