Peter C. Lyon
Peter Lyon is Special Counsel with the firm's Construction
Law group. Mr. Lyon's practice emphasizes environmental and
natural resources, claims resolution, professional liability/construction
defect defense for design professionals, and related insurance
matters. Mr. Lyon has over 20 years experience with environmental
claims - six years as an environmental engineer and ten years
as counsel. He has litigated claims to conclusion through
jury and bench trials in both federal and state courts.
Mr. Lyon's environmental experience is diverse, including
litigation and counseling on claims involving RCRA, CERCLA,
CWA, CAA, and state law equivalents, natural resource damages,
Prop. 65, UST fuel leaks, brownfields, toxic torts, and products
liability, especially in connection with soil and groundwater
contamination. He has litigated complex insurance coverage matters
arising from underlying environmental claims. Additionally,
he has advised clients regarding potential environmental liabilities
in corporate and real estate transactions, coordinated the environmental
aspects of due diligence investigations, and provided counsel
regarding claims of consultant liability in environmental assessments.
Mr. Lyon's natural resource damages litigation experience
includes litigation and resolution of the largest forest fire
resources damage clai m in United States history as of 2008.
The United States' resource damage claims arose from a massive
wildfire impacting two US National Forests.
Mr. Lyon's professional liability and construction defect
practice includes defending architects, engineers and environmental
professionals against errors and omissions, delay, breach of
contract and related claims. He also counsels design professionals
on contract negotiation and risk management practices.
