Under the flexible standard for finality adopted in Dhillon v. John Muir Health (2017) 2 Cal.5th 1109, the superior court’s order remanding this case to the civil service commission for its entry of additional findings and conclusions to support the discipline it imposed on a county employee was not final or appealable. The order did not finally dispose of the issues raised by the County’s mandate petition but instead reserved jurisdiction for the court to review the commission’s revised decision and to decide the employee’s backpay claim. Also, no issue would evade eventual appellate review if the appeal from the interlocutory order was dismissed.
