The bankruptcy court did not abuse its discretion in converting this Chapter 13 bankruptcy into a Chapter 7 bankruptcy despite the fact that the debtors had filed a motion to voluntarily dismiss their Chapter 13 case under 11 USC 1307(b). That section gives the debtors an absolute right to leave Chapter 13, but not to leave the bankruptcy court. And here, the court found ample evidence of abuse of Chapter 13 in the debtors’ failure to move forward with the case or file tax returns for 17 months. The fact that there were on-going criminal proceedings did not give them the right to sit on their Fifth Amendment right to avoid self-incrimination an impediment to basic bankruptcy administration of their estate.
