Under CCP 2025.295, the deposition of a plaintiff can take no longer than 7 hours if (a) the action is for injury or illness from mesothelioma, and (b) a doctor certifies that the plaintiff suffers from mesothelioma raising a substantial medical doubt that plaintiff will survive beyond six months. If more than 20 defendants appear at the deposition, the court may extend the time limit up to a total of 14 hours. This decision holds that the court has no power to extend the time for the plaintiff’s deposition beyond those limits. The Legislature enacted the section specifically to abrogate Certainteed Corp. v. Superior Court (2014) 222 Cal.App.4th 1053, which had held that the court could extend the time limit on depositions under prior law.
