The communicable disease extension of the comprehensive property insurance policy that Fireman’s issued to Amy’s provided coverage for the costs of remediating, cleaning, disinfecting, etc. the premises after a communicable disease event, defined to mean “an event in which a public health authority has ordered that a location be evacuated, decontaminated, or disinfected due to the outbreak of a communicable disease at such location.” This decision holds that the policy doesn’t cover jurisdiction-wide COVID-19 closure orders, but does cover orders requiring decontamination of Amy’s manufacturing facilities in particular–and without any added requirement of physical alteration of those premises. The trial court correctly sustained Fireman’s Fund’s demurrer but should have given Amy’s leave to amend to state it had received location-specific decontamination orders.
