Lab. Code 2778 codifies the ABC test of employment for wage and hour purposes for most California worders, but expressly exempts real estate licenses, stating that their status is determined under Bus. & Prof. Code 10032 which in turn incorporates the test stated in Unemployment Ins. Code 650 and 13004.1. Under that test, a real estate agent is an independent contractor, not an employee, if (1) he is duly licensed with the Dept. of Real Estate, (2) he is paid by commission, not hourly, and (3) his employment contract says he will not be treated as an employee for income tax purposes.
