28 USC 1367(d) provides that when a case is brought within the federal courts’ original jurisdiction and state law claims are also asserted, invoking the federal court’s supplemental jurisdiction, any applicable statute of limitations is tolled for a period of 30 days following dismissal of the state law claims if the federal court declines to exercise jurisdiction over them. This decision holds that the dismissal occurs and the 30 day grace period begins to run when the district court’s dismissal is affirmed by the Court of Appeals. The time is not further tolled by the plaintiff’s request for relief from the district court’s dismissal under FRCP 60(b) or during any appeal from denial of relief under that section. The plaintiff is also not entitled to common law equitable tolling while seeking Rule 60(b) relief in the district court.
