The bankruptcy code does not authorize a release and injunction that, as part of a Chapter 11 plan of reorganization effectively seek to discharge claims against a nondebtor without the consent of affected claimants. Under 11 USC 1123(b), a Chapter 11 plan may contain five specific types of orders, all of which concern the debtor’s rights and responsibilities, and ” any other appropriate provision not inconsistent with the applicable provisions of this title.” The quoted catchall phrase is interpreted under ejusdem generis to include only orders similar in type to those of the five specified types which precede the catchall phrase. The catchall cannot be expanded to include nonconsensual release of claims against nondebtors who have not surrendered all their assets to administration of the bankruptcy court.
