Although defendant may have violated Civ. Code 2923.6 initially by recording a notice of sale before expiration of the time for plaintiff to appeal from defendant’s denial of plaintiff’s application for a loan modification, defendant cured the error and rendered it immaterial by waiting 18 months after it denied plaintiff’s appeal to file another notice of sale under which it eventually sold the property.  The decision rejects plaintiff’s argument that the denial of her application and appeal were incorrectly based on a supposed deficiency in her submitting required documents to support the modification application.  HBOR does not give a remedy for incorrect decisions on loan modification applications or require denial on substantive rather than procedural (non-submission of required documents) grounds.
