The trial court erred in granting Staples summary judgment on plaintiff’s Equal Pay Act claim under Lab. Code § 1197.5. Following federal cases, this decision holds that a plaintiff can establish a prima facie case of an Equal Pay Act violation by showing she was paid less than a single male comparator. It is not a defense to show that on average women are paid as much as men in that position or that some comparator men were paid less than the plaintiff. Staples failed to submit proof of a bona fide non-sex-related reason for the particular wage disparity shown by plaintiff’s evidence, but at trial might show that the wage difference was justified by seniority or some other factor. The trial court correctly granted summary judgment to Staples’ parent corporation and to plaintiff’s boss at Staples, neither of whom was her employer and hence not liable for any Equal Pay Act violation.
