This decision affirms a judgment holding that San Francisco’s ordinance requiring landlords to pay enhanced relocation assistance amounts to tenants displaced when the landlords exercise their rights under the Ellis Act to exit the rental market conflicts with and is preempted by the Ellis Act.  The enhanced relocation assistance payments imposed a prohibitive price on the landlords’ exercise of their Ellis Act right to withdraw units from rental use.
