An employee who engages in sales activities for the employer in a fixed location at which the employer exercises control and supervision over the employee, by requiring the employee to clock in and out and other measures is not subject to the outside salesman exemption to Labor Code wage and hour provisions. The exemption was intended to shield employers from liability for workers whose hours and work the employer could not control or monitor. Here, demonstrators who each operated at a single Costco store, who clocked in and out with the employer, and who worked in a restricted space assigned to the employer could be monitored and supervised so exempting them would not serve the purpose of the outside salesman exemption.
