Plaintiff, as a 17-year old student, engaged in a fight with another student in class. The teacher intervened and in trying to separate the two students, fell on plaintiff, breaking his leg. This decision affirms a judgment on a jury verdict for the defendant teacher and school district finding they were not negligent. There was conflicting evidence as to negligence, so the trial court correctly denied plaintiff’s JNOV motion. The court did not err in refusing plaintiff’s special instructions on a school’s duty of care to protect students because the defendants conceded they owed a duty of care, and the jury was instructed that they owed a duty of care. The same standard of care applied as in ordinary negligence cases. And plaintiff could not show any prejudice from the refusal to give his instructions.
