Under Cal. Rules of Ct., rule 3.1702, a motion for award of attorney fees through judgment must be filed within the time for an appeal from the judgment. When the case is in the superior court’s limited jurisdiction, the appeal deadline is 30 days from service of notice of entry of judgment. Here, defendant served and filed its attorney fee motion 66 days after service of notice of entry to the superior court’s affirmance of the appealed administrative decision fining plaintiff. The motion was properly denied as untimely.
