A contract that provided that Party A agreed to pay “for all third party costs incurred by Party B to collect overdue invoices” was a clause providing for recovery of attorney fees since they are likely third party expenses incurred in attempting to collect overdue invoices. Mastronardi International Limited v. SunSelect Produce (California), Inc. (E.D. Cal. Aug. 23, 2019, No. 1:18-cv-737) 2019 U.S. Dist. LEXIS 143934 and Oklahoma Fixture Co. v. ASK Computer Systems, Inc. (10th Cir. 1995) 45 F.3d 380 reach the same result based on similar contract language.
