Sandquist v. Lebo Automotive, Inc.

The arbitrator, rather than the court, determines whether an arbitration agreement permits classwide arbitration unless the agreement clearly assigns that decision to the court.

Following the plurality opinion in Green Tree Financial Corp. v. Bazzle (2003) 123 S.Ct. 2402, this 4-3 decision holds that whether an arbitration clause permits classwide arbitration is an issue for the arbitrator to determine unless the arbitration agreement provides otherwise.
