The Legislature amended H&S Code 1799.102 after Van Horn v. Watson (2008) 45 Cal.4th 322 to extend the statutory immunity for Good Samaritans who render emergency medical or nonmedical care or assistance at the scene of an emergency. For these purposes, H&S Code 1797.70 defines “emergency” to mean “a condition or situation in which an individual has a need for immediate medical attention, or where the potential for such need is perceived by emergency medical personnel or a public safety agency.” This decision affirms a summary judgment for Costco and its employee who responded to a fist fight between customers at a Costco gas station. The employee reasonably perceived that one or both combatants were in heed of immediate medical attention or might be soon. Fists can inflict serious injury. And plaintiff had the other fighter in a headlock that could lead to asphyxiation. The steps the employee took to separate the fighters were reasonable and taken in good faith. So he and his employer were entitled to immunity under section 1799.192.
