This decision affirms an Anti-SLAPP dismissal of a malicious prosecution action against a mandatory reporter of elder abuse for an allegedly knowingly false report of elder abuse by plaintiff, accusing her of attempting to kill an elder by smothering him with a pillow. Plaintiff also claimed that defendant then coerced the elder into corroborating the false report, leading to criminal charges being brought against plaintiff (though they were later dropped). The absolute immunity granted mandatory reporters of elder abuse by Welf. & Inst. Code 15634 does not allow any exception for knowingly false reports. And allowing a nonstatutory exception would thwart the statute’s purpose of encouraging the reporting of elder abuse. The alleged coercion of the elder occurred close in time to the initial report of elder abuse and was closely connected to that report, so it fell within the absolute immunity as well.
