We have all known that the 2020 and 2021 hiatus in mortgage litigation could not last. The question is how to plan for, respond to and resolve the likely pandemic of litigation to come. Some of issues that will be covered include the CARES Act, deferral and forbearance frameworks, credit reporting requirements, the CFPB’s COVID-19 servicing rule, AB 3088 and SB 1079, two of California’s new mortgage servicing laws, and issues arising out of the national housing market boom.
